Tingley campaigners are preparing for a third fight to stop a McDonald’s restaurant opening on their doorstep after the fast-food chain appealed the decision made by planning chiefs.
The controversial planning application to open a 24-hour drive-thru restaurant on the site of the White Bear pub off Tingley roundabout, was refused for a second time by planning chiefs almost six months ago, but campaigners were told that a planning appeal was lodged within days of the deadline for an appeal ending.
But Coun Robert Finnigan said that the appeal may not be accepted and it is in the hands of the Planning Inspectorate who will decide whether or not they have made a ‘legitimate’ appeal.
Coun Finnigan said: “We know that McDonald’s have lodged an appeal against the last refusal, but we do not know and have not had confirmation that it is legitimate.
“We don’t know the reasons they are appealing on and we also don’t know if it has been made within the statutory time scale of six months - if it isn’t then it could be declared invalid.
“This is a half-hearted attempt by McDonald’s, because if they had a strong case they would have appealed within weeks, not at the last minute.”
Coun Finnigan said it now a case of “watch this space” and wait for Planning Inspectorate’s decision.
He said: “It could fall at the first hurdle and there’s no point in getting all fired up yet, but we’re geared up to battle on if we need to. We just need to see what happens.”
