A mobile phone shop owner sexually assaulted a 13-year-old customer at his Morley business premises when she went to get her phone repaired, a court heard.

Agha Khan, 34, carried out the offence on the youngster which was caught on CCTV.

Leeds Crown Court heard Khan tried to kiss the girl at his shop, Morley Mobiles in Queen Street, on March 24 this year.

Robert Stevenson, prosecuting, said the girl went to the shop to collect her phone after taking it in for repair.

Khan began talking to the girl and asked her if she had a boyfriend before telling her she was pretty.

Khan then came from behind the counter and pulled the girl towards him and hugged her.

He asked her for a kiss but she refused. Mr Stevenson said Khan asked her again for a kiss and pulled her by the waist towards him.

The victim again refused to kiss him. Khan then made comments about the girl’s breasts.

Police were contacted after the victim told a school friend about what had happened.

Khan was arrested and initially denied doing anything wrong. He then admitted trying to kiss the girl after being shown CCTV footage of the incident.

Khan, of Conway Road, Harehills, pleaded guilty to sexual assault.

Imran Khan, mitigating, said his client had pleaded guilty at an early stage and was of previous good character.

He said the father-of-two was a hard working family man.

The barrister added: “He is ashamed and remorseful for what happened.”

A probation service report assessed Khan as a low risk of re-offending and recommended that he needed treatment to prevent further offending.

The Recorder of Leeds,

Judge Peter Collier, QC, made Khan the subject of a three-year community order, during which he must take part in a 60-day rehabilitation activity programme.

Khan was also told he must carry out 120 hours unpaid work and must go of the sex offenders register for five years.

The judge told him: “You have got a conviction for sexual assault and that is something that will live on your record and no doubt embarrass and cause you difficulties in the future.”
